Conditions of Use

Terms of Use

The following terms of use apply to customers who purchase products from this site as well as general viewers of all content within.

Guarantee

All products sold, to the best of our knowledge at time of sale, are in working condition and free from defect. Unforeseen damages may occur due to improper manufacturing or packaging; in this case we will cooperate fully in the replacement or refunding of the purchase. Shipping costs cannot be refunded.

This web store is based on technology developed by a third party, and we cannot be held responsible for any problems caused by defects in the store technology. However, we would greatly appreciate notification if any such defects appear.

Damage Disclaimer

Purchasing Bradatech products implies that the customer understands the correct use of the product. In all cases we will attempt to provide adequate documentation to prevent improper usage. However Bradatech cannot be held responsible for any damage to life, property, or finance resulting from customer use of our products or unintentional manufacturing defects.

Because of the complexity of the aerial systems we sell, and the fact that many of these products include parts and systems from vendors and suppliers not affiliated with Bradatech, our company cannot be held liable for any failure originating from these parts and systems. Purchasing aerial systems from us means the customer understands that Bradatech is responsible for the assembly, construction and testing of the platform only. The customer/operator/owner is ultimately responsible for operating the aerial system and ensuring it is safe to do so at his/her own risk.

It is recommended that purchaser and operator not fly without purchasing Liability Insurance. This helps cover costs in the event that persons are hurt or property is damaged as a result of use. In general, standard Liability Insurance does not cover model aircraft.

The result of injury or property damaged by use of, but not limited to products sold by Bradatech is the sole responsibility of the user.

Bradatech warrants that all products will be free from material defects at the time of delivery. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

INDEMNITY

BRADATECH AGENTS, REPRESENTATIVES AND EMPLOYEES ARE TO BE HELD HARMLESS FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, AND EXPENSES (INCLUDING ATTORNEYS' FEES ACTUALLY INCURRED) ON ACCOUNT OF DEATH OR INJURY TO ANY PERSON OR DAMAGE TO ANY PROPERTY ARISING FROM OR IN CONNECTION WITH ANY PRODUCTS SOLD OR SUPPLIED BY BRADATECH.

THIS INDEMNITY SHALL APPLY WITHOUT REGARD TO WHETHER THE CLAIM, DAMAGE, LIABILITY OR EXPENSE IS BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR OTHER TORT.

How Commercial unmanned air vehicles are regulated in Canada: (from Transport Canada website)

New Regulations as of November 2014 from Transport Canada

Permission and safety requirements
To fly your unmanned aircraft legally, you may need to follow strict safety conditions outlined in an exemption or apply for permission from Transport Canada. It depends on the type of aircraft, its weight, as well as how and where you plan to use it.

If your aircraft:

  • Weighs 35 kg or more, you need to apply for a Special Flight Operations Certificate before you can use it.
  • Weighs less than 35 kg and is used for recreational purposes, you don't need permission to fly.
  • Unmanned aircraft that weigh less than 25 kg may qualify for an exemption to the rules, which will allow you to fly without permission.

If your aircraft:

  • Weighs 2 kg or less and you can meet the safety conditions in the Transport Canada exemption for UAVs that weigh less than 2 kg or less, you don't need to request permission to fly.
  • Weighs between 2.1 kg and 25 kg and you can meet the safety conditions in the Transport Canada exemption for UAVs that weigh between 2.1 kg and 25 kg, you don't need to request permission to fly.

However, you must email Transport Canada with:

Your name, address, and phone number
    UAV model and serial number
    A description of the operation
The geographical boundaries of the operation

If you cannot or choose not to meet the safety conditions in the UAV exemptions, you must apply for a Special Flight Operations Certificate.

Be SAFE and be SMART!
